Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Netpedia Inc. ("Netpedia", "we", "us", or "our"), including web hosting, domain registration, SSL certificates, and related services. By creating an account or using any of our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

1. Acceptance of Terms

You must be at least 18 years of age and capable of entering into a legally binding agreement to use our services. By accepting these Terms, you represent that you meet this requirement and that all information you provide is accurate and complete. These Terms form a legally binding contract between you and Netpedia governed by the laws of Ontario, Canada.

2. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with third parties.
  • You are responsible for all activity that occurs under your account, whether authorized by you or not.
  • You must notify us immediately at support@netpedia.ca if you suspect unauthorized access to your account.
  • You must provide accurate, current, and complete billing and contact information and keep it updated.
  • Accounts are personal; you may not resell access to your account (unless you hold a Reseller Hosting plan).

3. Services

Netpedia provides the following services subject to availability:

  • Shared, VPS, Cloud, and Reseller web hosting
  • Domain name registration and management
  • SSL certificates
  • Email hosting and related communication services

We reserve the right to modify, suspend, or discontinue any service with reasonable notice. We strive to maintain 99.9% uptime and will provide advance notice of planned maintenance where possible.

Service Level Agreement (SLA): In the event we fail to meet our 99.9% monthly uptime guarantee, you may be eligible for service credits. Credits are calculated as a percentage of your monthly fee proportional to downtime and must be requested within 30 days.

4. Payments and Billing

  • All fees are quoted and billed in Canadian dollars (CAD) unless otherwise stated.
  • Hosting services are billed in advance on a monthly or annual cycle as selected at checkout.
  • Invoices are due upon receipt. Accounts with unpaid invoices may be suspended after 7 days.
  • Domain registrations and renewals are non-refundable once processed with the registry.
  • All prices are subject to applicable Canadian federal and provincial taxes (HST/GST).
  • 30-Day Money-Back Guarantee: New shared hosting accounts are eligible for a full refund within 30 days of initial purchase. This guarantee does not apply to domain registrations, VPS, cloud, or reseller plans.
  • Chargebacks initiated without first contacting our support team may result in account suspension and a $25 CAD chargeback fee.

5. Acceptable Use Policy

You agree not to use our services to:

  • Host, distribute, or transmit illegal content under Canadian or applicable international law
  • Send unsolicited bulk email (spam) or engage in phishing, fraud, or deceptive practices
  • Distribute malware, viruses, ransomware, or any malicious code
  • Conduct or facilitate DDoS attacks, port scanning, or unauthorized access to third-party systems
  • Host illegal file-sharing hubs, warez, or content that infringes intellectual property rights
  • Host child sexual abuse material (CSAM) — violations are reported to authorities immediately
  • Mine cryptocurrency in a manner that excessively consumes shared server resources
  • Host content that harasses, threatens, or incites violence against individuals or groups
  • Violate any applicable laws or regulations, including Canada's Anti-Spam Legislation (CASL)

We reserve the right to suspend or terminate accounts that violate this AUP immediately and without notice. We may report illegal activity to the relevant authorities.

6. Backups

While Netpedia performs regular backups on eligible plans, you are solely responsible for maintaining your own independent backups. Backup availability is not guaranteed and backups should not be relied upon as your only recovery mechanism. We are not liable for data loss regardless of cause.

7. Limitation of Liability

To the maximum extent permitted by applicable Canadian law, Netpedia's total liability to you for any claim arising under these Terms shall not exceed the fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages including loss of profits, data, or business opportunities.

8. Termination

You may cancel your account at any time from your client area or by contacting support. Upon cancellation, your services will remain active until the end of the current billing period; no partial refunds are provided except under the 30-day money-back guarantee.

We may terminate or suspend your account immediately for breach of these Terms, non-payment, or conduct that we reasonably believe poses a risk to our infrastructure or other customers. Upon termination, all data in your account may be permanently deleted within 30 days.

9. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website at least 30 days before taking effect. Your continued use of our services after the effective date constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada. You irrevocably submit to the exclusive jurisdiction of those courts.
